Terms and Conditions

Access to the Metal Roofing Alliance (MRA) Web Site ("Site") is provided to you subject to the following terms and conditions which may be updated by MRA from time to time ("Terms and Conditions"). In addition, use of certain areas of the Site is subject to additional conditions or rules applicable to such areas and those conditions or rules are hereby incorporated by reference. The Terms and Conditions are a legally enforceable agreement with the respect to your use of the Site, subject to MRA's right to make modifications at any time as described below. By using this Site, you accept and agree to be bound by the Terms and Conditions. If you do not agree to the Terms and Conditions, you should not use this Site.

  1. Purpose of Site
    MRA maintains this Site as a source of information about the metal roofing industry for those who may choose to access this Site ("users").

  2. Right to Change or Modify Terms
    MRA reserves the right, at its sole discretion, at any time, to change the Terms and Conditions. You should review this agreement periodically for any changes to the Terms and Conditions which shall be effective upon posting. By using the Site after changes to the Terms and Conditions have been posted, you agree to accept the changes and abide by them whether you have reviewed them or not.

  3. Registration
    You can browse the Site or you may choose to register to take advantage of additional services, such as the Find a Contractor or Ask the Experts features. If you register on the Site, you agree to provide current, complete, and accurate registration information. MRA reserves the right to suspend or terminate your use of the Site and/or any feature of the Site, in the event you provide any information that is inaccurate or incomplete, or MRA has reasonable grounds to suspect that such information is inaccurate or incomplete.

  4. User Conduct
    The Site may contain bulletin boards, discussion groups, chat rooms, or other message, third party content or communication facilities (collectively, "Forums"). You agree to use the Forums only to send and receive messages and material that are proper and related to the Forum. By way of example, and not as a limitation, you agree that when using a Forum, you shall not do any of the following:
    1. Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
    2. Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent, or unlawful material or information.
    3. Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consents.
    4. Upload or attach files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer.
    5. Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded.
    6. Falsify the origin or source of software or other material contained in a file that is uploaded.

    MRA reserves the right to terminate your access to the Site or any feature of the Site, at any time in our sole discretion, with or without notice, if we believe that your conduct fails to conform with the Terms and Conditions, to investigate and to involve and cooperate with law enforcement authorities, and to pursue a civil lawsuit or criminal prosecution for any alleged or actual illegal activities involving the Site or any of its services.

  5. Use of Site Content
    The Site contains information, text, graphics, software, and other content (the "Site Content"). The Site Content is protected under the copyright laws of the United States and of other countries. Unless indicated otherwise on the Site Content, you must contact us for permission for any reproduction, modification, or distribution of such Site Content. Some Site Content may have been submitted by third parties, and may be subject to more specific restrictions, as indicated on such Site Content.

  6. Contributed Content
    MRA does not claim ownership of content you submit or make available ("Contributed Content") for inclusion in the Site, its services, and Forums. However, with respect to original Contributed Content for inclusion in the Site, its services, and Forums, you grant MRA a perpetual, royalty-free, world-wide license to use, distribute, reproduce, make derivative works, edit, publish, translate, publicly perform, and publicly display such Contributed Content (in whole or in part) and to incorporate such Contributed Content into other works in any format or medium now known or later developed. If you contribute content that does not constitute your original work of authorship as defined under US Copyright Law, but a third party holds the copyright and other proprietary rights to such content, you represent and warrant to MRA that your work does not infringe on any third party's copyright or other proprietary rights and that you have secured all necessary permissions and licenses prior to contributing such content to the Site, its services and Forums.

  7. Public Forums
    All Forums are public and not private communications. Chats, postings, conferences, e-mails, and other communications by other users are not endorsed by the MRA and such communications shall not be considered reviewed, screened, or approved by MRA. MRA reserves the right for any reason to remove without notice any Contributed Content.

  8. Copyright Notice
    If you believe in good faith that your copyrighted work has been reproduced on the Site without authorization in a way that constitutes copyright infringement, please advise us at once.

  9. Trademarks and Logos
    Metal Roofing Alliance, MRA®, the MRA logo, Investment Grade Roofing® and Investment Grade Roofing® Quality Contractor are trademarks of MRA. MRA trademarks may not be used or associated with any product, event, or link without the prior consent of MRA. Requests for permission to use MRA's trademarks should be addressed to [email protected].

  10. DISCLAIMER OF WARRANTIES
    THE SITE CONTENT IS PROVIDED "AS IS" AND "AS AVAILABLE". MRA DOES NOT WARRANT THE AVAILABILITY OF THE SITE NOR THE ACCURACY, COMPLETENESS, OR CURRENCY OF THE SITE CONTENT OR ANY MATERIAL PROVIDED THROUGH THE FIND A CONTRACTOR PROGRAM, ASK THE EXPERTS OR OTHER FORUMS, AND DOES NOT WARRANT THAT THE SITE OPERATES ERROR-FREE, NOR THAT DEFECTS, ERRORS OR OMISSIONS WILL BE CORRECTED OR THAT THE SITE IS COMPLETELY SECURE.   13. Find a Contractor and Quality Contractor Programs
    MRA's Find a Contractor program (the "Program") is intended to serve only as an informational resource for MRA website users. The Find a Contractor program provides users with a tool to locate metal roofing contractors near their home. Contractors are solely responsible for their performance and delivery of services and for meeting applicable Program requirements. MRA exercises no control or direction over metal roofing contractors and does not endorse, warrant, guarantee or assume any responsibility for the products, services, or performance of any of the contractors listed in the Program. MRA urges you to exercise care in selecting any contractor or material supplier, including checking contractor references, and looking at installations completed by the contractors in your area. Links to other web sites may be provided as part of the Program. The links are maintained by the respective companies or entities, and they are solely responsible for their content.

  14. Ask the Experts
    The "Ask the Experts" feature is a forum ("Forum") for exchanging information concerning residential metal roofing, including general material and metal roofing and metal roofing installation questions. Answers provided by contributors are based on the limited information posted and, therefore, may not provide a complete or accurate answer under all the relevant facts and circumstances. The views and opinions of persons expressed in the Forum do not necessarily state or reflect those of MRA or its members, and they may not be used for advertising or product endorsement purposes.

  17. Governing Law: Choice of Jurisdiction
    This agreement and the Terms and Conditions will be interpreted and enforced in accordance with the laws of the District of Columbia, United States of America. You agree to the exclusive jurisdiction of the courts of the District of Columbia.

  18. Automatic Renewal (for Member Contractors)

    FOR MRA MEMBER CONTRACTORS: YOU HAVE THE OPTION OF PAYING YOUR MEMBERSHIP DUES UNDER MRA'S AUTOMATIC RENEWAL PROGRAM. BY OPTING-IN TO AUTOMATIC RENEWAL, YOUR MEMBERSHIP DUES WILL BE AUTOMATICALLY CHARGED TO YOUR CREDIT CARD ANNUALLY ON YOUR MEMBERSHIP RENEWAL DATE. YOU WILL BE CHARGED AT THE RATES THEN IN EFFECT FOR YOUR MEMBERSHIP LEVEL, WHICH CURRENTLY ARE: $1,000 FOR THE SILVER LEVEL OF MEMBERSHIP AND $2,500 FOR THE GOLD LEVEL OF MEMBERSHIP. MRA RESERVES THE RIGHT TO CHANGE THE DUES STRUCTURE AT ANY TIME FOR ANY REASON AND YOU WILL BE CHARGED THE APPLICABLE MEMBERSHIP FEE AT THE TIME OF RENEWAL. IF THE DUES STRUCTURE CHANGES, YOU WILL BE NOTIFIED VIA EMAIL PRIOR TO THE RENEWAL DATE.

    ONCE SELECTED, AUTOMATIC RENEWAL WILL CONTINUE AS LONG AS YOU ARE AN MRA MEMBER, UNLESS YOU NOTIFY MRA TO DISCONTINUE THE AUTOMATIC RENEWAL OPTION. YOU MAY DISCONTINUE THE AUTOMATIC RENEWAL OPTION AT ANY TIME BY CONTACTING AN MRA MEMBERSHIP REPRESENTATIVE DIRECTLY AT 410-534-6900 OR BY LOGGING INTO YOUR ACCOUNT HERE AND CHECKING THE "NO" OPTION UNDER AUTOMATIC RENEWAL. IF YOU DISCONTINUE AUTOMATIC RENEWAL, YOU WILL STILL BE REQUIRED TO PAY YOUR ANNUAL MEMBERSHIP DUES BY THE RENEWAL DATE IN ORDER TO MAINTAIN YOUR MRA MEMBERSHIP. PLEASE NOTE THAT MEMBERSHIP DUES ARE NOT REFUNDABLE.
